The Commission must receive the criminal history record information for any proposed transfer of 5% or more of the license or the entity holding the license. If the transferee is an entity, the criminal history record information must be submitted for any individual holding 5% or more of the transferee entity. This applies to publicly traded and privately held entities. 

“Criminal history record information” consists of the results of a fingerprint check through Maryland Criminal Justice Information Services (CJIS) and the results of a fingerprint check through the Federal Bureau of Investigation (FBI). 

An individual who is required to provide criminal record history information may report to any CJIS location in Maryland for fingerprinting and request that a copy of the results be sent to the Commission by including the following information on the Livescan Application:

• ORI # MD920525Z

• Agency Authorization # 2100001956

If an individual lives outside of Maryland and is unable to report to a CJIS location in Maryland for fingerprinting, that individual should email enforcement.mmcc@maryland.gov for further

Upon receipt, Commission staff will conduct an initial review to determine whether all required information has been provided and whether any additional information is necessary to evaluate the request. The request will not be provided to Commissioners for review until all required information is submitted, and required fees paid. Once all required information is received, the request will be provided to Commission members for review, and approved or denied by a vote of the full Commission.

Depending on the terms and complexity of the proposed transfer, the review and approval process may take 45 days or more. All proposed transfers must comply with Health-General Article, §§ 13-3301-13-3316, and COMAR 10.62.08, 10.62.19, and/or 10.62.25. A proposed transfer may not take effect until formal approval is received.
